Principles of Personal Data Protection and Processing

GlobalSec a.s., Company ID: 07492961, located at Karlovarská 1698/1, 163 00 Prague 6, registered in the Commercial Register maintained by the Municipal Court in Prague under file no.: B 28415 (hereinafter referred to as the "controller" or "we") cares about the protection of your personal data. Please read how we process and handle your personal data.

The controller processes personal data in accordance with relevant legal regulations, such as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 110/2019 Coll., on the processing of personal data.

    • This Personal Data Processing Policy (hereinafter referred to as the <strong>"policy"</strong>) applies to the processing of personal data of the following subjects:

      • Your company's identification details, bank account number, and invoice numbers (issued and received).
      • Number (and identification) of vehicles or other objects to be tracked, and contact details for drivers for unit installation purposes.
      • Data relating to the driving/movement style of tracked objects.
    5. If you are our customer, we process the following personal data:

      • Personal identification data, such as first name, last name, company registration number (IČO), tax identification number (DIČ).
      • Address details, such as correspondence address and registered office.
      • Contact details, such as email address and phone number.
      • Bank account number, and invoice numbers (issued and received).

    7. If you contacted us via the contact form on our website, we process your personal data including your first name, last name, email, phone number, company identification details, and number of vehicles.

    9. Purposes and Legal Bases of Processing
    10. We process your personal data for several reasons, which we describe below. However, each reason must be supported by a legal basis for processing to ensure that the processing of personal data by the company is lawful and compliant with applicable laws.

      • Preparation, fulfillment, record-keeping, and conclusion of service agreements and purchase agreements, based on the legal basis of contract fulfillment or measures taken before concluding such a contract.
      • Tax and accounting purposes, particularly invoice issuance, payment processing, and accounting, based on the legal basis of fulfilling legal obligations applicable to the company as a personal data controller.
      • Informing you about our company news and online marketing (displaying relevant ads based on your behavior on websites and stored cookies), based on the legal basis of the company's legitimate interests.
      • Contacting potential customers, based on the legal basis of the company's legitimate interests.
      • Testimonials for our services, based on the legal basis of consent to the processing of personal data.
      • Maintaining all communication related to contracts we have concluded together or whose conclusion we have facilitated, fulfilling obligations from these contracts, based on the legal basis of contract fulfillment or measures taken before concluding such a contract.
    12. If you are our customer, we process your personal data for the purposes of:
      • Debt collection if you have not paid what you were supposed to pay according to the contracts you have concluded with us, or protection and enforcement of our rights in any potential legal disputes, based on the legal basis of our legitimate interest.
      • Preparation, fulfillment, record-keeping, and conclusion of the contract, based on the legal basis of contract fulfillment or measures taken before concluding such a contract.
      • Tax and accounting purposes, particularly invoice issuance, payment processing, and accounting, based on the legal basis of fulfilling legal obligations applicable to the company as a personal data controller.
      • Maintaining internal records of business partners, based on the legal basis of the controller's legitimate interests.
      • Fulfilling public-law obligations applicable to the company, based on the legal basis of fulfilling legal obligations applicable to the company as a data controller.

If you contacted us via the contact form, we process your personal data to process and send a response to your inquiry, or an offer, based on the legal basis of contract performance and taking steps at your request before entering into a contract. This is a legal term; this legal basis does not mean we are entering into a contract with you when you contact us via the contact form. We understand that you are simply interested in something, want to discuss something, or request an offer. You may also be informed about our company news via online marketing (displaying relevant ads based on your behavior on the website and stored cookies), based on the legal basis of legitimate interests of the company.
    15. If you are a job applicant at our company, we process your personal data for the purpose of conducting the recruitment process, based on the legal basis of taking steps at your request before entering into a contract (even if we ultimately do not agree on cooperation).

Similarly, when contacting us via an inquiry or contact form, you must provide us with personal data so that we can contact you in response to your inquiry or question; providing personal data is therefore a contractual requirement. Providing personal data is also a contractual requirement for job applicants so that we can contact you and include you in the selection process.

    2. If we are to provide you with the service you request, we will need your personal data; unfortunately, this is unavoidable. Providing personal data is therefore a contractual requirement, and without it, we cannot conclude the relevant contracts and commence cooperation.

If you, as our prospective business partner, wish to conclude a contract with us, we also need your personal data in order to cooperate with you and fulfill our obligations arising from the concluded contract. Providing personal data is therefore also a contractual requirement in this case, and without it, we cannot conclude the contract.
  7. You grant your consent to the processing of personal data in connection with the purposes of processing listed above, which have consent as their legal basis. However, you may revoke your given consent at any time free of charge and without giving reasons by sending written notification of the revocation of consent to the address of the controller's registered office or by sending an email to info@globalsec.cz.

    2. In some cases, we may need your consent to process your personal data. However, processing is not always based on consent, so we will only request your consent where necessary to process your personal data.
  8. We always retain personal data for the necessary and appropriate period for the given purpose, i.e., the reason why we are processing your personal data. The retention period is determined primarily using the following logic:
    1. Do you always have to give us your consent to process your personal data?
    2. If you sign any contract with us, it is necessary to retain your personal data not only for the duration of the contract but also after the termination of our contract. This is the case, for example, due to withdrawal from the contract, claims for damages, therefore, we retain your personal data for 10 years from the conclusion of any contract, or for 10 years from the date of termination of the contract (sometimes we may withdraw from the contract if you do not fulfill your contractual obligations, or we agree on a different termination of our cooperation and thus the contract). Therefore, we cannot delete your personal data immediately after the conclusion of the contract or the provision of the service.
    3. According to applicable legal regulations, we are also obliged to retain, for example, tax documents for 10 years from the end of the tax period in which the performance took place, including the personal data contained therein.
    4. We retain personal data from inquiry and contact forms for 1 year from the submission of the inquiry or your message via the form, unless we have established cooperation with you and you have not become a prospect, customer, or business partner.

      • For the time necessary to protect the company's rights.
      • For the duration of the company's legitimate interests, if such a period is appropriate to the purpose of processing.
      • For the period specified by law.
  9. Personal data is not transferred to third countries outside the EU.
    1. For the time necessary to establish, exercise or defend legal claims.
    2. Access to personal data is granted only to authorized employees, sales representatives, and collaborators. To ensure our operations, we also share your personal data with an external accountant to the extent necessary for their work. Our IT specialist, tax advisor, and legal counsel also have access to certain personal data. We may also share your personal data with relevant state authorities, public authorities, and banking institutions. Furthermore, we may share personal data with our legal representatives and other parties for the purpose of protecting our rights. All recipients of your personal data are obligated to protect your personal data in the same way as we do, in accordance with applicable laws. If these recipients process personal data as processors, we have concluded the appropriate contracts with them.
  10. **In addition to the rights mentioned above, you also have the right to object to processing concerning your specific situation, for example, if we are processing your personal data for our legitimate interests.**

      • What are your rights regarding the processing of personal data?
      • Right of access: You can request that we inform you what personal data we process, and you may be granted access to this data, i.e., provided with a copy of the processed personal data.
      • Right to rectification: You can also request that we correct inaccurate or complete incomplete personal data.
      • Right to erasure: You can also request the erasure of your personal data; under certain conditions, we are obliged to erase this personal data, but not always; in some cases, we may retain personal data.
      • Right to restriction of processing: Under certain conditions, you also have the right to request restriction of processing, e.g., if you dispute the accuracy of personal data and we are verifying its accuracy.
      • Right to data portability: You also have the right to data portability, meaning that under certain conditions you have the right to receive data in a structured, commonly used, and machine-readable format.
      • Right to withdraw consent: Finally, you have the right to withdraw your consent to the processing of personal data at any time without giving any reason.
      • Right to lodge a complaint and to an effective judicial remedy: If you suspect that we are violating the law or other applicable legislation in the processing of your personal data, you have the option of filing a complaint with the Office for Personal Data Protection and the right to an effective judicial remedy in this area.
