Terms of Use of the Application

GlobalSec Mobile App Terms of Use

(hereinafter the "Terms")

BY DOWNLOADING, INSTALLING, AND USING THE GLOBALSEC APPLICATION, YOU ACCEPT AND AGREE TO THESE TERMS OF USE AND CONFIRM THAT YOU HAVE READ THE INFORMATION ON THE PROCESSING OF PERSONAL DATA.

1. Definitions
1. Operator means GlobalSec a.s., located at Karlovarská 1698/3, Praha 6, 163 00, Czech Republic, Company ID: 07492961.
2. Application means the mobile application called GlobalSec, whose main functionalities include:
• Real-time online vehicle position view.
• Notification settings for: trip start/end, attempted vehicle theft, power failure, speeding, etc.
• Trip log – history of trips made by the monitored object, including date, time, distance traveled, maximum and average speed.
• Geofence settings – setting a so-called protected zone, i.e., a defined boundary; if the monitored object crosses this boundary, the user receives an immediate notification via the GlobalSec application.
• Maximum speed limit setting – setting a speed limit; exceeding this limit will trigger a notification via the GlobalSec application.
• Driver rating – an algorithm that monitors and evaluates the driving style of the monitored object.
and which is available via the AppStore or Google Play or by downloading from the link at https://technotrasa.cz. The Application is operated only in Czech.
3. GTC means these General Terms and Conditions.
4. Agreement means the agreement concluded between the User and the Operator, the subject of which is the granting of a License to use the Application to the User under the conditions specified in these GTC.
5. User means any legal or natural person other than the Operator who uses the Application.
6. User Account means the non-public part of the Application, accessible to the user after entering Login Credentials, allowing the User to use all or part of the Application's functionality.
7. Login Credentials means a unique combination of the User's login name and password chosen by the User, which the User saves to the Application's database when setting up a User Account via the Application and/or automatically generated by the Application for the User.
2. General Provisions
1. The operator of the mobile application (hereinafter referred to as the "Application") is GlobalSec a.s., located at Karlovarská 1698/3, Praha 6, 163 00, Czech Republic, Company ID: 07492961, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. B 18415 (hereinafter referred to as "GlobalSec" or "Application Operator").
2. These terms and conditions govern the basic rules for using the Application. The User who downloads and installs the Application to a mobile phone or other device with iOS or Android operating system (hereinafter referred to as "User") and further uses it agrees to these Terms and Conditions. The User is obliged to follow these Terms and Conditions, the terms and conditions of the store operator allowing the download of this Application, good manners and further comply with the applicable laws of the Czech Republic when using the Application.
3. Downloading and installing the App, logging into the App, using the App
1. The Application can be used by Users who have downloaded and installed it on their mobile or other device from a third party (application store operator, e.g., AppStore or Google Play). Some features of the Application are only available when the mobile or other device is connected to the internet.
2. **Unauthenticated User:** The app cannot be used without logging in.
3. **App Login (Authenticated User):** To log in to the App, a User Account is required. Therefore, only (i) a User who already has a User Account and has a contract with the Operator, or (ii) a User who has created a User Account themselves using the registration form link (email, password, password confirmation, first name, last name) received after purchasing one of the Operator's products, can log in to the App. Based on this email-verified registration, a User Account is created for the User, and subsequently, they log in to the App simply by entering the login credentials sent to the email address provided during registration.
4. When creating a user account, the User is obligated to provide all required information accurately and truthfully. We will rely on the accuracy and truthfulness of this information.
4. Other Terms of Use of the Application
1. The User is entitled to terminate the use of this App and uninstall it from their device at any time. This does not affect the validity of the contract concluded between the User and the Operator or the existence of the already created User Account.
2. The User is not permitted to use the App in violation of the App's Terms of Use, good morals, and legal regulations; to interfere with the App, its software environment, its individual functions, its source code; to create, distribute, or sell/provide copies of it; to copy or reproduce the App; to modify or change the App in any way; to perform reverse engineering, decompilation, derivation, or conversion from machine code; to derive other programs or products from the App; to grant any rights to the App; or to otherwise infringe the intellectual property rights (including copyrights) of the Operator or third parties. All of the above applies to the App as a whole or its individual parts. The User must not use the App for any commercial, sales, business, or similar purposes.
3. Any information, text, images, design, graphics, trademarks, logos, trade names, and other content, including the software itself, are protected by the intellectual property rights of the App Operator or other persons. The User may not use them in any way without the consent or licensing from the App Operator.
4. The User is obligated to use the App in a way that does not compromise its security or the security of the data stored in it (in particular, they must not download or install programs from untrusted sources on their mobile phone or other device; they must check their mobile device or other device and use security measures that prevent third parties from accessing the mobile phone or device and that protect it from computer and other viruses; they must use a secure internet connection and secure Wi-Fi networks, etc.). The User acknowledges that the App may contain personal data (especially for Authenticated Users) and undertakes to make every effort reasonably expected of the User to protect such data. The App Operator is not liable for the loss or misuse of data or other damages in this context that were caused by the User's use of the App in violation of these Terms or were caused by computer or other viruses or other malicious programs.
5. In case of suspected or proven violation of these Terms of Use or violation of legal regulations or good morals in the use of this App by the User, the Operator is entitled to take all necessary steps to interrupt or prevent the User's access to the App without prior notice and without any compensation. This does not affect the Operator's right to full compensation for any damages incurred in connection with such actions by the User.
6. The Operator is entitled (but not obligated) to update the App continuously (e.g., to improve or add its functions, for security, technical, or other reasons) and to perform system maintenance. For these purposes, the Operator is also entitled to interrupt the operation of the App for the necessary time or to limit its functionality without incurring any obligation or liability towards the User for any damage resulting therefrom to the User or a third party. The User will be notified in advance of planned maintenance or updates. The App Operator is not liable for any damages incurred by the User in connection with the interruption of the App's operation, its unavailability, other technical errors, or changes in the User's mobile device or other device resulting from the installation or use of the App.

6. Applicable Law, Changes to Terms
1. The legal relationship between the App Operator and the User is governed by the applicable laws of the Czech Republic. Any disputes arising between the App Operator and its User will be resolved by the courts of the Czech Republic; local jurisdiction will be determined according to the Operator's registered office. This in no way affects any rights of the User as a consumer.
2. The App Operator may change these Terms at any time, effective from the date of publication of the new version of the App's Terms of Use on www.globalsec.cz or in the App. If the User does not agree with the new terms, they may terminate the use of the App and uninstall it from their device at any time; this does not affect the User's right to do so at any time during the use of the App. The invalidity or ineffectiveness of one provision does not cause the invalidity or ineffectiveness of the other provisions of these Terms. Such invalid or ineffective provision shall be replaced by a provision whose meaning most closely approximates the invalid/ineffective provision.
3. The App uses technical and analytical tools. The purpose is to ensure functionality and the ability to use all services and to improve the performance, appearance, structure, and content of the app. All information we obtain in this way is not directly linked to the user. We do not obtain information about a specific app user.
